1. About Us
Branest & Co Ltd is a private limited company registered in England and Wales, providing short-term holiday accommodation and property management services in Birmingham and the West Midlands. References to “we”, “us” or “our” refer to Branest & Co Ltd.
2. Eligibility
By making a booking, you confirm that:
- You are at least 18 years of age
- You have the legal capacity to enter into a binding agreement
- All information provided during the booking process is accurate and complete
- You are authorised to make the booking on behalf of all guests in your party
We reserve the right to refuse or cancel any booking where we reasonably believe these conditions are not met.
3. Bookings and Confirmation
A booking is confirmed only when you receive a written confirmation from us or from the relevant booking platform (Airbnb, Booking.com, or direct). Until confirmation is received, no contract exists between us.
Where bookings are made through third-party platforms, the platform’s own booking terms will also apply alongside these Terms.
Direct bookings
For direct bookings made through our website, a deposit of 25% of the total booking value is required to secure your reservation. The remaining balance is due no later than 14 days before your check-in date. For bookings made within 14 days of check-in, full payment is required at the time of booking.
4. Pricing
All prices displayed are in Pounds Sterling (GBP) and include VAT where applicable. We use dynamic pricing and rates may vary depending on season, demand, and booking lead time. The price confirmed at the time of booking will not change unless you make material amendments to your reservation.
Additional charges may apply for:
- Extended stays beyond the agreed checkout time
- Late check-in requests (where staff attendance is required outside standard hours)
- Additional cleaning requirements beyond normal usage
- Pet fees (where pets are permitted, must be agreed in advance)
5. Security / Damage Deposit
A refundable security deposit may be required prior to or at check-in. The amount will be stated at the time of booking. The deposit will be returned within 5 business days of checkout, less any deductions for:
- Damage to the property or its contents beyond fair wear and tear
- Excessive cleaning requirements
- Missing items from the property inventory
- Unpaid charges incurred during your stay
We will provide an itemised account of any deductions made.
6. Guest Responsibilities
As a guest, you agree to:
- Treat the property and its contents with care and respect
- Not exceed the maximum occupancy stated in the listing
- Not hold parties, events, or gatherings without prior written consent
- Comply with all noise restrictions and neighbour disturbance guidelines (quiet hours apply between 10pm and 8am)
- Not smoke inside any property, all Branest & Co properties are strictly non-smoking indoors
- Not bring pets unless the property is listed as pet-friendly and prior consent has been obtained
- Report any damage or maintenance issues to us promptly during your stay
- Vacate the property by the agreed checkout time and return all keys or access devices
Please note: Violation of occupancy limits, noise policies, or the smoking/pet rules may result in immediate termination of your stay without refund. We may also claim damages in respect of any losses incurred.
7. Our Responsibilities
We will:
- Provide the property in a clean, well-maintained, and safe condition
- Ensure all advertised amenities are available at the time of your stay
- Respond promptly to any issues or complaints raised during your stay
- Provide a 24-hour emergency contact number for urgent matters
Where a property becomes unavailable due to circumstances beyond our control (such as emergency maintenance, flood, fire, or other unforeseen events), we will endeavour to offer you an alternative property of equivalent standard or a full refund of monies paid.
8. Cancellations
Our cancellation terms are set out in our Cancellation Policy, which forms part of these Terms and should be read in conjunction with them.
9. Liability
To the fullest extent permitted by law, Branest & Co Ltd will not be liable for:
- Loss or theft of personal belongings during your stay
- Personal injury arising from your own negligence or that of third parties
- Any disruption caused by events outside our control (including but not limited to utility outages, extreme weather, or works by neighbouring properties)
- Loss or damage arising from use of third-party booking platforms
Our total liability to you in connection with any booking will not exceed the total value of your booking. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any matter that cannot be excluded by law.
10. Intellectual Property
All content on the Branest & Co Ltd website, including text, photographs, logos, branding, and design, is the intellectual property of Branest & Co Ltd or its licensed suppliers. You may not reproduce, distribute, or use any content from our website without our prior written permission.
11. Short-Term Rental Registration
From summer 2026, all short-term rental properties in England are required to be registered under the national short-term rental registration scheme. All properties listed by Branest & Co Ltd will be registered in compliance with this requirement. Registration numbers will be displayed on all listings where required by law.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or from any booking shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to These Terms
We reserve the right to update these Terms at any time. The version in force at the time of your booking will apply to that booking. We recommend reviewing these Terms before each new booking.
